Tax Resolution: Options for Non-Payment of Michigan Sales Tax

If you own a business in Michigan and have not paid your sales tax, the state will eventually computer generate assessments for you. These are generally over stated by thousands of dollars.
The State of Michigan will then file liens based on these assessments, and soon thereafter, they will attempt to collect the debt by issuing a bank levy.
Options that exist are as follows:
- Contact the state to determine which periods need to be filed and which periods have assessments on file.
- File all missing SUW (sales, use and withholding) forms. The filing of these will cause their computed assessments to adjust to what is commonly referred to as "actual" returns.
- If a balance is due, a request can be made to pay off the balance via an installment agreement. The terms of the repayment will vary from case to case - based on the financial condition of the business along with several other factors.
Keep in mind that the State of Michigan contracts with a third party debt collection - yes, a collection agency. They are known as MARCS or GC Services. Often times, the taxpayer is not aware that the toll free number that is calling them is NOT the state of Michigan, but is in fact a collection agency.
It is also possible that you will receive a visit or a letter from a local collection officer from state treasury. Generally, he\she will give a very short window to comply with various deadlines. If those deadlines are missed, the next action take is collection. Collection action may include bank levy's and seizures.
