Contrary to popular belief, it is possible to appeal a tax lien that has already been filed by the IRS. When a tax lien is filed the IRS has to send out a notice within 5 days to the taxpayer. The notice includes a request that gives you the option of requesting a hearing. Be aware that if you do chose file a request that you have to submit it within 30 days after the fifth day of the lien being filed. Before you appeal your lien you need to have your case reviewed by an IRS manager or request a Collection Due Process hearing with the office of appeals. The request must be appealed by the date noted on the notice you received from the IRS in order for it to be considered. It may sound like a lot to go through, but it is definitely worth it. The good news is that if you win your appeal the lien will be released.
